Overbooking and denied boarding: what should a passenger do?

Volunteering to give up a seat is not the same as involuntary denied boarding. Get the choice and every promised benefit in writing.

When a flight is oversold, the airline may first seek volunteers to surrender reservations in exchange for agreed benefits. Ask for the payment, voucher, hotel and replacement-flight terms in writing before accepting.

If EU air-passenger rules apply and you checked in on time with a valid reservation and documents, involuntary denial for overbooking or operational reasons can trigger a choice of reimbursement or rerouting, care and possible compensation.

Volunteer or involuntary denial?

A volunteer's benefit comes from the agreement with the airline. Involuntary denied boarding is different from refusal caused by late arrival, missing documents, health or security grounds.

Check whether EU rules apply

  • Flights within the EU may be covered regardless of carrier.
  • Flights departing the EU may be covered regardless of carrier.
  • Flights arriving from outside are generally covered when operated by an EU carrier.
  • The regime also covers Iceland, Norway and Switzerland.

The core choice

Where eligible, the airline should offer a one-off choice: reimbursement and, where relevant, return to the starting point; rerouting at the earliest opportunity; or rebooking for a later convenient date subject to seats. Choosing one changes your rights to the alternatives.

  • Request the reason in writing.
  • Keep reservation, boarding pass and baggage tag.
  • Capture every offered option.
